Depakote (divalproex sodium) is an anti-seizure medication manufactured by Abbot. It is marketed under the brand names:
- Depakote
- Depakote ER
- Depakote sprinkles
Serious injuries have resulted from Depakote, including some that resulted in a "Black Box" warning. Depakote has also been shown to link to Stevens Johnson Syndrome, a serious skin disease. Brown & Crouppen is accepting litigation claims for those injured as a result of taking Depakote.
The FDA has approved its use to treat only three conditions--epilepsy, bi-polar disorder and migranes. The FDA requires its most serious warning, a "Black Box" warning, on the Depakote label, warning that injuries from Depakote can be very serious, even fatal[1]. This is because Depakote can cause life-threatening problems, including:
- Birth defects, such as spina bifida, when taken during pregnancy
- Pancreas problems
- Pancreatitis
- Liver failure
While drug products may be helpful in some cases, toxic and dangerous reactions and consequences can complicate treatment and recovery for some patients. Medical malpractice refers to doctors' errors, but in situations where manufacturers did not disclose serious side effects, the physician may not be liable. Our law firm offers a no-cost case evaluation if you have questions about your treatment with Depakote or any other dangerous drug or medical product.
Illegal marketing?
Recently, the Department of Justice joined in a whistle-blower lawsuit[2] alleging that Abbott illegally promoted Depakote for off-label use. "Off-label" use is when a drug is prescribed to treat a non-approved condition. Doctors can legally prescribe drugs off label but it is against the law for drug companies to market their drugs for off-label uses.
Drug manufacturers are responsible for providing a safe and effective product. Injury lawyers at Brown & Crouppen help bring justice to those who suffered serious side effects which were not disclosed to patients when they were evaluating treatment with these dangerous drugs. Claims against these manufacturers can help bring closure when serious consequences occur.
If you or a loved one has been harmed by taking Depakote you may be entitled to compensation. Please consult your physician before discontinuing any medication. The experienced lawyers at Brown & Crouppen provide tough, aggressive representation for victims and their families. We are familiar with these cases and are ready to help.
