What Our Clients Say About Our Accomplished Attorneys
Our greatest success is the trust of our satisfied clients. Clients confidently refer their loved ones to Brown & Crouppen because they know we will provide the same exceptional care and commitment that they received as clients.
Who Can Be Held Liable for My Motorcycle Accident Injuries?
One or more parties can be liable for a motorcycle accident. Parties that may have played a part in the accident that caused your injuries may include:
- Another driver
- An employer if the other driver was on the job
- A trucking company
- A rideshare company
- A government agency or employee
- A manufacturer of a defective motor vehicle part
You may also be liable for your accident under Minnesota’s comparative fault law, which prevents you from recovering compensation if you are more than 50 percent responsible for your injuries.
Minnesota’s comparative fault law reduces collectible damages in a motorcycle accident claim proportionately, as long as you are less than 51 percent responsible for the accident. For example, if you are awarded $100,000 for damages and are 20 percent responsible for the accident, you can collect $80,000. In contrast, if you are awarded $100,000 and are 51 percent responsible, you cannot receive compensation for your damages.
Decades of experience have taught our Minneapolis motorcycle accident attorneys that insurance companies will blame victims to minimize compensation. Brown & Crouppen Law Firm can level the playing field on your behalf by collecting evidence that proves the other party’s liability and minimizes yours.
What Types of Compensation Can I Recover After a Motorcycle Accident?
Though Minnesota is a no-fault state, basic motorcycle insurance does not include personal injury protection (PIP) that covers riders’ medical expenses. Instead, motorcyclists turn first to the other driver’s liability insurance or a lawsuit for damages. Damages you can seek include:
- Medical expenses and future medical costs
- Rehabilitation
- Lost wages and future earnings
- Property damage
- Scarring and disfigurement
- Pain and suffering
- Emotional harm, such as PTSD or loss of enjoyment of life
You can also file a wrongful death suit on behalf of a loved one following a motorcycle accident. In a wrongful death lawsuit, you can seek additional damages for funeral expenses, loss of future benefits, and loss of support and guidance of your loved one.
Brown & Crouppen Motorcycle Accident Claim Highlight
At Brown & Crouppen, we represented a client who suffered a complex leg fracture in a motorcycle accident that required an external fixator device and multiple surgeries. After gathering strong evidence, we entered mediation on the client’s behalf, which led to the insurance company settling for $375,000. We also filed an underinsured motorist compensation claim to meet our client’s remaining needs. That claim resulted in an additional $75,000 in compensation.
While putting a number on the average motorcycle accident claim settlement is difficult, you deserve an accomplished team of lawyers fighting for the compensation you need.
"The best way to maximize the value for your motorcycle accident claim is first, make sure that you report that accident to the police so that we have a report showing what happened on that day and there's no dispute about what happened and when it happened. The second best thing you can do is to get immediate treatment for your injuries. If need be, go to the emergency room or the urgent care center, follow up with your doctor, make sure that your doctor knows all of your complaints and that you're getting all the treatment you need for your injuries you have in the accident. Especially in a motorcycle accident where we see a lot of head injuries, you're gonna wanna make sure you get those evaluated quickly and that you get the treatment you need for them. Getting your injuries evaluated and treated is the best way to maximize the value of your case."

Can I Still Receive Compensation if I Wasn’t Wearing a Helmet During the Accident?
In most cases, you can receive compensation if you were not wearing a helmet during a motorcycle accident. However, insurance companies or courts may try to reduce your compensation by blaming you for the severity of your injuries.
Minnesota’s comparative fault rules impact the amount of compensation you receive. These rules prevent you from recovering compensation if you are more than 50 percent responsible for your injuries.
Unfortunately, juries often perceive motorcycle riders as reckless, even when no evidence exists. Our award-winning Minneapolis motorcycle accident attorneys can help navigate these jury biases.
Other Laws Impacting Liability and Compensation in a Motorcycle Accident Case
In addition to a helmet requirement, Minnesota Statute section 169.974 establishes several other rules motorcyclists must follow, including:
- Having a license with a motorcycle endorsement or a permit
- Keeping headlights must be on at all times while riding
- Wearing protective eye coverings
- Prohibiting lane splitting or overtaking except under specific conditions
Do I Need a Lawyer if the Insurance Company Offers a Settlement?
Sometimes, you only realize that you need a motorcycle accident lawyer after receiving a settlement offer. Insurance companies often offer low settlements to individuals they know are facing financial pressures, and they sometimes unfairly claim that you are mostly at fault for your injuries.
Brown & Crouppen is here to help fight for the compensation you deserve. We have attorneys who have worked for insurance companies, so we know how they operate. We will notify the insurance company that a low offer is unacceptable and fight to get you the compensation you need. If they refuse to settle, we are not afraid to go to trial on your behalf.
Common Types of Motorcycle Accident Cases We Handle
In 2023, in the metro region that includes Minneapolis, there were 134 people injured and 25 fatalities in motorcycle crashes. Both of these numbers represented significant increases since 2019, when there were 92 injuries and 17 deaths.
Common causes of motorcycle accidents include:
- Speeding
- Driving while impaired
- Failure to yield
- Improper lane changes
- Tailgating
- Distracted driving
Motorcycles are smaller than other vehicles, and riders have little protection from injury when a crash occurs. Our motorcycle accident lawyers have handled cases involving all types of injuries. We will support you in any way possible, from helping you find qualified medical professionals to fighting for you and your loved ones in court.
If you were injured in a motorcycle accident, we will leave no stone unturned to gather the evidence that supports your claim and get you the compensation you need to cover your injuries.
How Long Do I Have To File a Motorcycle Accident Lawsuit in Minneapolis?
Under Minnesota Statutes Section 541.05, the statute of limitations for personal injury claims is six years from the accident date. If you are filing a wrongful death claim, Minnesota Statutes Section 573.02 requires you to do so within three years of the date of death and no more than six years from the date the accident occurred.
While there are some exceptions to these limits, in most cases, filing late means losing your chance at compensation. When there is a delay, the insurance company may allege that something else caused your injuries. Get help from our accomplished Minneapolis motorcycle accident attorneys so insurers and defendants know not to play games with your claim.
