Determining Fault in a Multi-Vehicle Crash on I-70

In cases involving multiple vehicles, more than one at-fault party may exist. This can complicate an I-70 accident claim and make it more challenging to secure compensation. 

Missouri and Kansas both use comparative negligence systems, but with key differences. In Missouri, a plaintiff can recover compensation even if they are mostly at fault, as long as someone else also shares responsibility. This is known as pure comparative fault, and any damages awarded are reduced by the plaintiff’s percentage of fault. For example, if you are found 20 percent at fault in a $100,000 case, your recovery would be reduced to $80,000.

Kansas follows a modified comparative fault rule. You can only recover damages if you are found to be less than 50 percent at fault. If you are 50 percent or more responsible, you are barred from receiving compensation.

Understanding the Statute of Limitations for I-70 Accidents

Similarly, the statute of limitations does not toll for collisions involving minors or mentally incapacitated plaintiffs until the individual reaches adulthood or the disability is lifted. In the case of a fatality, the surviving family has three years from the date of the death to file a wrongful death claim, per § 537.100.
