- In May of 2026, attorney Tom Davis obtained a $400,000 settlement on behalf of a client who fell down a dangerous outside stairwell at her apartment complex. She fractured both of her arms in the fall.
- On February 13, 2025, the client was walking out of her second floor apartment during lunchtime with her dogs to take them for a walk in Cass County, Missouri. A snowstorm had blanketed the Greater Kansas City area the day before. As she attempted to descend the stairs that had snow and ice on them, one of the stairs shifted and caused her to lose her balance and fall down several stairs.
- The dangerously worn condition of the stairs, combined with the precipitation from the previous day’s storm that was not sufficiently cleared, caused her to lose her footing and slip and fall all the way down the stairs, and then hit the concrete at the bottom with her left shoulder and right arm, causing severe fractures to both arms.
- As a result of her fall, the client went to a nearby emergency room by ambulance and was in the hospital for several days, followed by inpatient rehab. When she was released home, she had to ask her brother to stay with her for a month while she recovered and because she could not use either arm. She continued her treatment for several more months.
- Tom and his team worked diligently with a codes expert to investigate the stairwell, take photos and measurements and produce a detailed report about how the stairs violated several city codes. The team also tracked down weather reports and forecasts showing how the storm should have been anticipated, but instead the snow and ice were not properly treated and removed.
- Tom also obtained x-ray films of the fractures and hired a medical illustrator to bring home the visuals of the client’s fractures and how losing the use of her left shoulder and right elbow took a significant toll on the client’s physical condition and her mental health while she was severely limited for several months. Tom also took Zoom videos of the client’s friends and family to provide testimony about how hard it was on the client to recover from her fall, and how she is still dealing with the after-effects from her injuries.
- The client was very happy with the result, and ready to move on from this difficult chapter in her life.
